= The Top Banned Books of 2023=E2=80=94and What=E2=80=99s in Store for 2024

The number of book bans co= ntinues to grow each year=E2=80=94and 2023 was no exception. PEN America re= ports that the 2022 =E2=80=93 2023 school year saw an increase of 33% in bo= ok banning from the previous year.

Here are the Top Ten Banned Books of 20= 23:

Throughout the 2022 =E2=80= =93 2023 school year, book bans occurred in 33 states, with Florida leading= the pack, according to PEN America.

= ;

Unfortunately, many of the= authors on 2023's top 10 list are no strangers to book challenges. In 2022= , Gender Queer by Maia Kobabe was #1 on the list of top banned books. In 20= 23, two of Ellen Hopkins' books made it to the top 10 list=E2=80=94and in 2= 022, the author's book Crank appeared on the list.

Why these books?

As we've previously covere= d, the increase in book challenges and efforts to ban books disproportional= ity affect material that focuses on sexual orientation, sexual identify, ra= ce, and racism.

New Laws Add Teeth To California=E2=80= =99s Prohibition On Employee Non-Competes

California recently enacted Senate Bill (SB) 69= 9 and Assembly Bill (AB) 1076, amending California=E2=80=99s Business &= Professions Code Section 16600, which generally prohibits employers from r= equiring that their employees enter into postemployment non-competition cov= enants. Both laws go into effect on January 1, 2024. This Client Alert summ= arizes the key provisions of each law below.

Background

Business & Professions= Code Section 16600 voids any contractual provisions by which a person is r= estrained from engaging in a lawful profession, trade, or business of any k= ind, except as otherwise provided for certain limited circumstances (e.g., = covenants entered into in connection with certain sales of an ownership int= erest in a business).

= ;

California courts have bro= adly interpreted Section 16600 to prohibit employers from entering into pos= t-employment noncompetition agreements as well as post-employment customer = non-solicitation agreements. While the issue has not been definitively sett= led, courts have also held that this prohibition extends to post-employment= employee non-solicitation provisions as well. As of January 1, 2024, there= will be two changes to this law that expand California=E2=80=99s prohibiti= on of these types of agreements with employees.

SB 699

SB 699 establishes that an= y contractual provision that is void under Section 16600 is =E2=80=9Cunenfo= rceable regardless of where and when the contract was signed.=E2=80=9D Ther= efore, employers are prohibited from attempting to enforce a contract in Ca= lifornia that is void under Section 16600 regardless of whether the contrac= t was signed and the employment was maintained outside of California. Under= the plain language of the statute, an out-of-state employer would be prohi= bited from seeking to enforce a non-compete against a former employee who r= elocates to California and begins working for a competitor, even if the non= -compete was expressly governed by and valid under another state=E2=80=99s = laws.

The law provides employees= with a private right of action for injunctive relief and actual damages. = =E2=80=9CAn employee, former employee, or prospective employee may bring a = private action to enforce=E2=80=9D the law and a prevailing plaintiff may r= ecover =E2=80=9Creasonable attorney=E2=80=99s fees and costs.=E2=80=9D The = addition of a private right of action and statutory attorneys=E2=80=99 fees= for prevailing plaintiffs increases the risk of litigation for employers g= oing forward.
